High Court stays disaffiliation of city architecture college

A division Bench of the Hyderabad High Court comprising Acting Chief Justice Dilip B. Bhosale and Justice A.V. Sesha Sai on Tuesday stayed the order of disaffiliation passed by Jawaharlal Nehru Fine Arts University, Hyderabad, against Varaha College of Architecture and Planning in Visakhapatnam.

The Bench was passing this far-reaching order which will have effect upon the running of common institutions serving both AP and Telangana mentioned in the tenth schedule of the AP Reorganisation Act, in a writ petition filed by Varaha College and Varahalakshmi Narasimha Swamy Educational Trust, Narava, Visakhapatnam. The petitioner complained that the disaffiliation order was passed as it is situated in AP State.

The Bench commented that any dispute between the two States over such institutes should be solved through an agreement between the two States. Or else, they have to leave it to the Centre to resolve the dispute. Till then, none of the States can unilaterally stop services to the people of other State. The court wondered how the Telangana State can issue notification for appointing Vice-Chancellor to the university.

It has to be done by both States and not by one State alone. The Bench ordered notices to the Union of India , the States of Telangana and A.P. and the university.
