Court orders FIR against real estate firm

A court here has asked the Delhi Police to lodge a case against real estate company BPTP for cheating a buyer by not allotting him a plot of land despite an agreement in 2006.

According to the complaint, buyer Mithun Aggarwal had applied for allotment of a 350 sq m residential plot in Parkland in Faridabad in response to an advertisement. The plot was allotted to him on payment of Rs.22.38 lakh.

The company then allotted Mr. Aggarwal an alternative plot of 302 sq m in an arbitrary manner. When he took the matter before the State Consumer Forum, a settlement was arrived between the two to allot 335 sq m of land on or before March 2012. But, the accused failed to do so.

The buyer later visited the project site and found that no demarcation existed there to identify the plot, besides lack of development work like roads, sewerage, electricity poles and other basic amenities.

The plot buyer’s agreement (draft), sent by the company to the buyer, revealed various other companies as the third parties, with whom Mr. Aggarwal had no dealing at all, the complainant charged.
