Payment of maintenance charges

We are living in a 25-year-old apartment in Madipakkam. It has two blocks and each block has 6 units. There is a flat owner’s association in place.

One of the tenants has not paid maintenance and common electricity meter charges. Despite complaining several times, he refuses to pay up. How do we resolve this?

At the outset, please get the Association duly registered. Also, incorporate necessary clauses in the bye-laws for levy and collection of maintenance and other expenses. It is advisable to have an arbitration clause in the bye-laws to deal with defaulters or any other issue relating to payment of maintenance. You can proceed against defaulting members legally only thereafter.
