Ghaziabad, May 2 : Bahujan Samaj Party's Rajya Sabha member Narendra Kashyap, arrested in the case of dowry death of his daughter-in-law, has sought his release rom jail to attend the parliament session.
The MP, detained in a jail here, moved an application before the court of Chief Judicial Magistrate (CJM) Ghaziabad, saying that since parliament is in session, he be allowed to attend under police custody.
"There is no provision in the jail manual for sending any accused under police custody," claimed lawyer Hariom Kashyap, who is also the uncle of the BSP parliamentarian's now deceased daughter-in-law, Himanshi.
The court adjourned the hearing for May 5 since the lawyer for the BSP leader sought adjournment. Parliament's current budget session is scheduled to come to an end on May 13.
Earlier in the morning, Narendra Kashyap's bail hearing was adjourned after special CBI Judge G. Sridevi was elevated to the post of district judge. Now the case would be heard by another judge.
The FIR against the Rajya Sabha member was registered under Sections 304 B, 498 A of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. The investigation is still continuing.
The complaint was filed by Hariom Kashyap, Himanshi's uncle and the lawyer in the case assisting the prosecution.
The MP and his wife Devendri Devi tried to dodge police and got admitted in the intensive care unit (ICU) of Yashoda Hospital for chest pain. But police arrested them on April 7 from the ICU after discussing their health situation with the attending doctor.
The MP's son, Sagar, was also arrested. All the three were sent to jail. Three other accused are on missing and still on the run, according to police.
