Travel firm stymies honeymoon trip, told to pay up

The central Mumbai district's consumer dispute redressal forum pulled up one of the top travel companies, Thomas Cook, for failing to reimburse the entire tour package amount to one of its consumers.

The consumer had to cancel the package because of the company's fault. The forum has asked the firm to pay the consumer the remaining amount of Rs 18,048 along with an additional amount of Rs 25,000 towards his mental agony, and Rs 5,000 towards the litigation charges.

On April 18, 2017, Seniyar Muthukumar, a Chembur resident, had booked a honeymoon package tour for Bali and had paid an amount of Rs.1,19,348 for the same. The tickets were booked for May 12, 2017.

On May 12, when the couple reached the airport, they got the check-in stamp on both their passports. However, they were informed that the flight was rescheduled for the next evening. When he had checked in, Muthukumar got the confirmation that there is no other connecting flight available from Malaysia to Bali, and therefore, he had to cancel the trip. Complainant sought a refund, and the company failed to refund the entire amount. An amount of Rs 18,048 was not given.

Aggrieved by the company's behaviour, he approached the consumer forum. The forum asked the company to file its reply, but the company representatives remained absent.

The forum, after going through the evidence, said: "As the tour was cancelled due to the fault of the company, the complainant is entitled to an entire refund. Besides, the complainant suffered mental agony as the tour was cancelled for no fault of his. Thus, he deserves compensation towards the mental agony too."

  • When he had checked in, Muthukumar got the confirmation that there is no other connecting flight available from Malaysia to Bali, and therefore, he had to cancel the trip.
