The Bombay High Court on Wednesday constituted a committee comprising officers from the court receiver’s office and Maharashtra State Legal Aid Services Authority to survey the Priyadarshani Park area and report whether there was any damage caused to the park due to the fire engine stationed there.

FIRE STATION ISSUE

A division bench of Chief Justice Manjulla Chellur and Justice NM Jamdar came down heavily on the Malabar Hill Citizens’ Forum for persisting with the issue of fire brigade even when there are other issues of double parking etc plaguing the area of Malabar hill. The court while posting the matter for final hearing on November 30 refused any interim relief saying “No sky will fall until then.” The HC has also asked Maharashtra Costal Zone Management Authority to clarify the CRZ status of the park and pthe lot on which the fire engine is stationed.

In an affidavit filed by the Brihanmumbai Municipal Corporation (BMC) through counsel Anil Sakhare and Advocate Trupti Puranik, the civic body opposed the plea saying, “It is the responsibility of the corporation to protect and preserve the life of citizens of Mumbai, and therefore there is a necessity to meet the requirement of fire safety of citizens living in and around Malabar Hill, which can be fulfilled by establishing a fire brigade at the plot allotted and reserved for the same.”

The affidavit also mentions that from the time the fire engine has been stationed, 29 calls have been attended.

Further, as per the standing fire advisory council, for every area having a population of 50,000 people including a cluster of buildings, one fire appliance is required. The areas of Malabar hill, Bhulabhai Desai road, Napeansea road, Walkeshwar are densely populated.

According to the affidavit the fire engine does not create any obstacle or hindrances to the general public. It does not create any nuisance as alleged by the association.

The Malabar Hill Citizens’ Forum (MHCF) has challenged the corporations’ decision to set up a fire brigade station inside the park. The MHCF had moved the court claiming that several trees were cut own  to make way for the fire tender vehicles.
