Hitting a false note : HC asks popular singer to cough up Rs10 lakh within four weeks
The Bombay High Court has directed singer Mika Singh to shell out Rs10 lakh for unauthorised use of artist Sonu Nigam's picture in self-publicity hoardings in 2013. Justice S J Kathawalla has directed Singh to pay the amount within four weeks.
Nigam had dragged Singh to court after the latter put up hoardings carrying a big picture of himself and smaller images of many other artists, including Nigam's, who were to perform at a music award function. The hoardings were put by Singh through OCP Music and Bright Outdoor Media.
Nigam's counsels Ashish kamat and Priyanka Khimani informed the court that though the hoardings bore the logo of the event, they were different from the official posters and that Singh had used their client's image without permission.
It was alleged that hoardings were defamatory in nature as they gave an unjustified and incorrect impression to the public about the prominence and importance accorded to Singh at the awards as compared to the other artists.
Nigam's lawyers also informed that the singer plans to donate the amount to charity. Accordingly, Justice Kathawalla asked Singh to pay the amount of Rs 1 lakh each to the 10 charity organisations named by Nigam.
The court further restrained Singh from using Nigam's image without his permission or infringing his personality rights, performer's rights and publicity and image rights in any way.
Singh and OCP Music were represented by Arjun P Bhagat & Co whereas Bright Outdoor Media was represented by advocate Shoaib Memon. The counsels have given an undertaking that the defendants will pay the amount within four weeks and submit the receipts.
