The three owners of 1 Above eatery, which was gutted in the Kamala Mills fire on December 29, have been rearrested in connection with a case of alleged non-payment of Provident Fund (PF) to their employees.

Kripesh Sanghvi, his brother Jigar, and their partner Abhijeet Mankar, who were already in judicial custody in the fire case, were arrested afresh by the NM Joshi Marg police on Thursday.

"It is alleged that they had not paid PF dues of Rs 8.65 lakh to their employees and accordingly, a case was registered against them last month by a Provident Fund inspector," said Deputy Commissioner of Police (DCP) Virendra Mishra, Zone III.

After Thursday's arrest, they were produced before Bhoiwada magistrate court, which remanded them in police custody till February 10, the DCP said.

In the current case, the trio was booked under Indian Penal Code sections 406 (criminal breach of trust) and 409 (criminal breach of trust by banker, merchant or agent), and section 14 of the Employees Provident Funds and Miscellaneous Provisions Act, 1952.

The three were first arrested in January after a devastating fire broke out at Kamala Mills Compound, which housed their eatery, 1 Above.

As many as 14 people were killed and over 21 were injured in the fire.

Other than 1 Above, another pub, Mojo's Bistro, was also gutted in the inferno.

Both the eateries shared a common terrace, and the owner of Mojo's Bistro, Yug Tuli, was also arrested.

The owners were charged with culpable homicide not amounting to murder, among other offences in the fire case.

Concerning the fresh case, police officials have said that the company didn't deposit the PF amount, which is a salary component of every employee, from May to November last year. "They have cheated over 100 employees.
According to the complaint, the amount involved is Rs 8.65 lakh," police officials had said earlier.
