ISIS recruit Areeb Majid seeks bail from Bombay High Court

Kalyan resident and suspected ISIS jihadist Areeb Majeed has moved the Bombay High Court seeking bail.

A division bench of justices PV Hardas and Ajey Gadkari on Wednesday heard Majeed's appeal filed through his advocate Mubin Solkar. However, as no one appeared for the National Investigation Agency (NIA), the court issued a notice calling upon the agency to file its reply within two weeks.

In his appeal filed under section 21 of the NIA Act, Majeed has argued that his custody can only be extended by a special designated NIA court. However, on February 25, a sessions court had heard the extension application filed by NIA, seeking more time to file the charge sheet. The court had then extended Majeed's judicial custody to March 11, which, according to him, amounted to illegal detention.

The petition prays for bail on the ground that because of the illegal extension of custody the accused's fundamental rights were violated.

Majeed was a student in a Panvel college before he allegedly decided to join the extremist outfit along with three other friends last May.

On November 28, 2014, Majeed was flown from Istanbul under NIA escort back to India. The NIA, earlier, told the court that the four youths were with other pilgrims for eight days and had then parted ways to actively participate in unlawful activities in Iraq and Syria.

Majeed is presently lodged in Arthur Road jail and has been charged under sections 16, 18 and 20 of the UAPA for conspiring to commit a terrorist act and being a member of a banned foreign terror outfit. He has also been booked under the stringent section 125 of the Indian Penal Code for waging war against the nation. His three accomplices — Saheem Tanki, Fahad Sheikh and Aman Tandel — are arraigned as wanted accused in the case.
