Innocent youths were falsely implicated by ATS in 2006 terror cases, allege Jamiat

Speaking at a conference, secretary of the Jamiat, Gulzar Azmi alleged that out of the total accused, some were innocent and were falsely charged by the ATS officers.

The officials of Jamiat Ulama E Maharashtra, an NGO, on Tuesday alleged that some officers of the state Anti-Terrorism Squad (ATS) had falsely implicated the Muslim youths arrested in Malegaon blast case of 2006, Mumbai serial train bombings and Aurangabad Arms Haul case which occurred in 2006.

Speaking at a conference, secretary of the Jamiat, Gulzar Azmi alleged that out of the total accused, some were innocent and were falsely charged by the ATS officers. The innocents were tortured in the custody and were forced to give statements that they were involved in the bombings and Arms Haul Case.

"The ATS officers were previously aware that the persons in police custody are not the real accused but they tortured them physically, took their forcible confessions by giving death threats or implicate them with other terror cases. Just on the basis of mere suspicion, the ATS arrested several Muslim youths on false charges. In the Mumbai train bombings, out of the 13 accused, two accused — Mohammed Ali Alam Shaikh and Asif Khan — were falsely implicated and made accused in the Malegaon blast case. The ATS did this while the accused were in judicial custody. ATS also attempted to turn the accused into approvers by visiting them at the Arthur Road jail," Azmi alleged.

Abdul Wahid (38), one of the acquitted accused in the Mumbai serial train blast case said, "Even though the three incidents had happened in different places and on different dates but there are several things common in them. All the incidents happened in 2006 and all the cases were handed over to ATS for probe. All the cases were investigated by then ATS chief KP Raghuvanshi and almost same officers had prepared the charge-sheet of all the three cases. The ATS used to send Rs1,000 cash and more to the accused of Malegaon blast to Byculla Central jail through a police constable while he was in judicial custody. The accused were purposely kept in Byculla jail so that the ATS could torture the accused and also could promise of resettlement overseas if they become approvers."

Alleging further Wahid said, "The nine accused of the Malegaon had to be released as the National Investigation Agency (NIA) did not possess evidences against them. The case was first probed by the ATS, then the CBI and later by NIA. Only after the NIA took over the probe, it was proved that the nine accused had spent five years in jail for the crime they did not commit. Similarly, the ATS decided to frame an accused named Faisal Ata Ur Rehman Shaikh charged for Mumbai bombings into the Aurangabad Arms Haul Case after two months of his judicial custody. The ATS have destroyed the lives of the arrested people and have attempted to grant them a bigger punishment. While acquitting the accused in Malegaon case, the judge observed that innocent men were made scapegoats by the ATS."

Jamiat had demanded strict action against the ATS officers from the judiciary, Azmi said.
