Enquire why info not provided, SCI to civic chief

The State Information Commission (SIC) has directed the Brihanmumbai Municipal Corporation (BMC) chief to make an inquiry into why no information was provided to an applicant who sought details of property and lease among others.

Dated August 24, it was passed by the state information commissioner, Ratnakar Gaikwad, on an application made by Suresh Kumar Dhoka, who has an office in Kalbadevi.

The applicant had sought information of property card, lease property, lessors, trustees, tenants in common, of a property in Bhuleshwar area near Kalbadevi post office. The applicant had stated that of the four lessees, only one is alive.

In particular, there was information sought on an illegal well in the vicinity. He had sought information on who asked for that well to be created.

The applications were made for the illegal well, and despite seven RTI applications being made, there was no information given to the applicant.

"For last 12 years, I have been a tenant of this place. It is municipal property given to the landlord. They have dug a well in the duct. For years together they had created problems. They even cut my water supply line because I was fighting against the illegal well due to which there was nuisance."

He added that another well was dug, from which tankers would come to fill water. "When I took over the tenancy, they said that they would stop the water tankers and blocking of the road. These people would often threaten me and despite complaints there was no hearing. When my only son suffered from dengue, due to water leakage and other problems, I made up my mind to fight this out," said Dhoka.

The Public Information Officer (PIO) did not give information despite the First Appellate Authority (FAA) directing him to do so. During the hearing, the commission cited details of several laws that make it binding on officers to clear the files in a given number of days.

Stating that the PIO had willfully not provided information, the commission directed the municipal commissioner to conduct an inquiry into the matter and send the report to the SIC. It also stated that the applicant be given all information by September 29. Ajoy Mehta, municipal commissioner did not respond to message from DNA.
