Court relief for Mhada engineer accused of hurting religious sentiments

The sessions court recently dismissed the allegation of hurting religious sentiments levelled against a government employee, granting him anticipatory bail. The court held that the allegation was "totally baseless".

The case dates back to June, when Damodar Suryawanshi, an executive engineer with the Maharashtra Housing and Area Development Authority, had approached a Girgaum-based building for its demolition. Almost 70% of tenants had given their approval, but the complainant (name withheld) in the case refused to move out of his residence. The officer, after obtaining permission from the authorities, had entered his house.

The officer had started gathering the things and items in the house and keeping them in a corner, when he came across a religious book, which he kept with everything else in the same corner. Over that the complainant had then raised an objection and filed a case of hurting his religious sentiments.

Officer Gaikwad, attached to the VP police station, said, "When officials come for demolition, it is a regular procedure to keep all articles on one side; hence, the book was among them. But this hurt the sentiments of the complainant and he approached us with the case."

The court, after going through the evidence, held, "It is clear from the papers that 70% tenants gave consent for development, with respect to others, the Mhada has initiated proceedings. Government authorities have also passed the order of vacating the premises. After passing the order, proper procedure has been followed and an inventory has been also prepared of the material found on the premises. The applicant is a government servant, working as an executive engineer with Mhada. The allegation regarding the religious book has no basis at all."
