'Bright' rape accused let out to write MSc exams

A 22-year-old tuition teacher, who is in jail for allegedly raping his teenaged student, was on Thursday granted interim bail by a sessions court so he may appear for his MSc exams.

The court was convinced by the arguments advanced by the defence advocate, who said the undertrial - slapped with sections of the stringent Protection of Children Against Sexual Offences Act (POCSO) - is a 'bright' student and wishes to complete his post-graduation in Mathematics. The arrested accused was thus granted bail for a period of almost 17 days, from March 31 to April 16, against a cash surety of Rs 30,000 .

It was on June 5, 2013 that the Sakinaka police had lodged a rape case against the accused after one of his 16-year-old students made the allegation. According to his s lawyer, the minor used to visit his residence for Maths tuition before her board exams, but the duo fell in love, and had a physical relationship. After February, however, the two parted ways upon realising their families wouldn't accept the relationship due to different religious persuasions. In June that year, the complainant started feeling uneasy and told her mother.

After a medical check-up, the doctors informed her that she was 20-weeks pregnant, and she immediately went for an abortion. But since she was a minor, the hospital authorities were bound to inform the police, who then registered a first information report against the accused.

Advocate Amanat Khan, appearing on behalf of the accused, told this newspaper, "My client is a bright student who used to take tuition. He has cleared his B Sc in Maths without seeking any coaching, and now he wants to complete his M Sc. Thus, we had approached the court seeking bail. And, looking at his conduct and capability, the court has granted him interim bail, so he can attend his exams."
