Bombay Parsi Panchayat trustee denied access to documents

Three out of five trustees signed the resolution.

Bombay Parsi Panchayat passed a resolution on Tuesday to deny access to any documents to one of its current trustee. According to the resolution, Viraf Mehta will not have access to documents or minutes until the majority of the BPP agree to it.

Three out of five trustees present in the board room signed the resolution. The three trustees who signed the document were Yazdi Desai, Kersi Randheria and Noshir Dadrawala while Armity Tirandaz and Viraf Mehta did not sign.

Confirming the passing of such a resolution against him, Viraf Mehta said, “Yes, such a resolution was passed against me on the basis of two case files I was looking at— one of which involved charges against my father, Dinshaw Mehta (ex-chairman, BPP) and another involved a lady who was allegedly living in one of the Baugs with her non-Parsi husband. It is mentioned in the resolution that I am denied access to any documents because I may have malafide intentions.”

Speaking in his defense, Mehta added, “I have never taken any documents out of the BPP office and returned by evening. I am as much a BPP trustee as anyone else and should have access to the documents. I have been legally elected by the Parsi community.”

On his plans for further action, Mehta said, “I am hoping that it gets sorted out across the table. However, as a last resort, I might have to consider approaching the charity commissioner.” 

A few years ago, Noshir Dadrawala has also been allegedly denied access to documents. He had then approached the Charity Commissioner and gotten a decision in his favour.

Kersi Randeria, who also signed the resolution, said, “It came across as if he wasn't looking at the data as a trustee but which might not be in the interest of the trust. Hence, he needs to inform the Trust before accessing the documents because earlier also documents have gone missing.”

In the same resolution passed on Tuesday, another BPP trustee Armity Tirandaz's name was also allegedly included in the resolution. However, her name was later removed and she was apologised to. Randeria said, “There was some confusion. However, her name hasn't been included in the resolution.”

Armity Tirandaz, Noshir Dadrawala and Yazdi Desai (BPP chairman) remained unavailable to comment on the issue.
