The bench then asked the additional solicitor general to present the certificate issued by the censor board before the court decides on the accused's plea, which states that if the film is released, it would prejudice the criminal trial, which is yet to commence, against him.

The Bombay High Court refused on Thursday to decide on a plea made by arrested Peter Mukerjea seeking a stay on the release of a Bengali film titled 'Dark Chocolate', which is allegedly based on the Sheena Bora murder case that Mukerjea is an accused in.

A division bench of justice SC Dharmadhikari and justice GS Kulkarni said: "In your case, we do not know where the film stands or whether it is going to be ready or not. Then why do we waste our time?" The observation came after the producers of the film — even while claiming that the film is in the post-production phase — said they have not applied for certification from the Censor Board of India.

The bench then asked the additional solicitor general to present the certificate issued by the censor board before the court decides on the accused's plea, which states that if the film is released, it would prejudice the criminal trial, which is yet to commence, against him.

The Bengali film based on the sensational Sheena Bora murder case is likely to be released soon. It stars Mahima Chaudhry in the alleged role of Indrani Mukerjea and Riya Sen as Sheena Bora, and is a fictional adaptation of the incident. The film has been shot in Kolkata and other parts of Bengal.
