Bombay HC allows Ram Navami event at Goregaon ground

The Bombay high court recently allowed the Sanjeevan Seva Foundation to hold its annual Geet Ramayan programme at the Sambhaji Raje Bhosale ground in Goregaon on March 29. The function will be held on the occasion of Ram Navami.

The Bombay high court recently allowed the Sanjeevan Seva Foundation to hold its annual Geet Ramayan programme at the Sambhaji Raje Bhosale ground in Goregaon on March 29. The function will be held on the occasion of Ram Navami.

The Vanrai police had refused to grant permission to the foundation as the ground falls in a silence zone.

The foundation had approached the court stating that the function is being organised for the 59th year and dignitaries like famous Marathi singer, composer and music director Sridhar Fadke have been invited.

The foundation argued in court that there is a private temple which is situated in the compound of a housing society nearby and as a result of that the said area has been declared as a silence zone. It also said that the court had granted permission to another trust to organise Ras-Garba of Navratri at the said ground in 2013. Moreover, the said event is going to take place only for one day and that too in the evening hours. The organisers have given an undertaking that the said function will be over by 10pm.

Additional government pleader VS Tiwari argued that in view of the Noise Pollution (Regulation and Control) Rules 2000, and also from the Rules dated April 21, 2009, the present ground has been declared as silence zone, and therefore, permission has been refused.

A division bench of justices VM Kanade and AR Joshi noted: "In our view, the facts in this case are more or less identical
with the facts of the said case (earlier case where garba was
allowed), and the event will take place for one day. There is no hospital or school in the vicinity; and secondly, since the event is being organised after 6pm; even if a there's a school, it will be closed by that time."

The court directed the foundation to use distributed sound system with low wattage loud speakers. Such an undertaking should be given to the police authorities concerned. "Since the Brihanmumbai Municipal Corporation granted permission to the foundation for the said event, in these circumstances, in our view, the police had no reason to refuse permission only on the ground of existence of a private temple, which is situated in the compound of a building."
