Supreme Court appoints amicus curiae in Bapu assassination case

The court reminded the petitioner Dr Pankaj Phadnis, a Mumbai-based researcher and a trustee of Abhinav Bharat, on the law of limitation before posting the matter for further hearing on October 30.

The Supreme Court has appointed senior advocate and former additional solicitor general Amrender Sharan as an amicus curiae on a petition seeking a reinvestigation in the Mahatma Gandhi assassination.

Initially, the court was inclined to dismiss the petition saying "nothing can be done in law". However, after briefly hearing the matter, a bench comprising Justices SA Bobde and L Nageswara Rao appointed Sharan to assist the court on this issue. The court wanted to know "whether it is wise and legal to reopen" this case.

The court reminded the petitioner Dr Pankaj Phadnis, a Mumbai-based researcher and a trustee of Abhinav Bharat, on the law of limitation before posting the matter for further hearing on October 30.

The petition seeks the reopening of the probe on the assassination on several grounds, including the 'possibility' of involvement of more people in the murder. The petition submitted that a probe in the case may reveal what could be one of the biggest cover-ups in history. Phadnis contended that the apex court never got the opportunity to examine the Gandhi assassination case, as convicts were hanged before it came into existence.
