SP leader Azam Khan's son Abdulllah found guilty of faking date of birth in election nomination paper

Trouble for Akhilesh Yadav-led Samajwadi Party are far from over. After resignations galore and defections of its MLCs to the BJP, the party may lose UP Assembly membership of one of its important MLA Abdullah Azam Khan, son of former Cabinet minister Azam Khan, for allegedly faking his date of birth in his nomination papers.

An inquiry conducted by the District Magistrate Rampur S.S. Awasthy has indicted Abdullah Azam Khan of faking his date of birth by fraudulently obtaining two PAN cards to contest Assembly polls. The DM has submitted his report to the Election Commission for action against the Samajwadi Party MLA.

On a complaint by a local RSS leader Akaash Saxena, the Election Commission had ordered an inquiry about a week ago. Akaash had alleged that Abdullah had faked documents to get two PAN cards with different birth dates in order to show his age above 25 years to contest Assembly elections.

In the report, it was found that Abdullah had got first PAN card on DFOPK6164K on August 30, 2013. His date of birth was shown as January 1, 1993 and address as Gher Meerbaaj Khan, Jail Road, Rampur. This PAN card was linked to his State Bank of India (SBI) account number 34341386006.

As per this PAN card, Azam’s son was ineligible for contesting Assembly polls 2017 from Swaar in Rampur. To increase his, another PAN card number DDWAPK7513R was obtained on March 24, 2015 in which his age was changed to September 30, 1990 with a wrong and different address House 124, Gher Meerbaaj Gher Hasan Khan, Tehsil Sadar, Rampur.

On the basis of this PAN card, Abdullah fraudulently obtained a fake birth certificate from Lucknow Nagar Nigam and filed his 2016-17 Income Tax return with it without cancelling the earlier PAN card which was linked to his bank accounts and earlier ITRs. He also got an Aadhaar Card made with the help of the second PAN card. In his Assembly 2017 nomination papers, the SP MLA used this second PAN card, fake birth certificate and fake Aadhaar card to show his age as 26 years to become eligible for contesting elections. Abdullah refused to file his replies when inquiry officer asked him to furnish his defense.
 
“After completing the inquiry, I have submitted my report to the Election Commission for appropriate action as per the law,” said DM Rampur. Sources in the Election Commission claim that as per Section 125 A of Representation of People’s Act, 1951 election of Abdullah from Swaar assembly seat in Rampur may be set aside. He may also face jail term up six months and fine or both.

The Delhi High Court also in one of its judgments in 2013 had categorically directed the commission to set aside election of any representative if found guilty of filing fake affidavits along with his nomination papers. Both Azam Khan and his son Abdullah are keeping a mum on the issue and have evaded media queries on the inquiry report submitted to the Election Commission.
