Radhe Maa moves Bombay High Court, wants case under Arms Act quashed

A criminal case was registered against Radhe Maa for carrying a trishul (trident) on a flight from Aurangabad to Mumbai last year.

Self-styled goddess Sukhvinder Kaur alias Radhe Maa, has moved the Bombay High Court seeking to quash and set aside the criminal case registered against her for carrying a trishul (trident) on a flight from Aurangabad to Mumbai last year. In her petition she claims that the trident was never used in Mumbai, and thus the Andheri magistrate court issuing directions to register FIR under section 156 (3) of the Criminal Procedure Code (CrPc) was done without proper application of mind. Furthermore, the magistrate should have also taken into consideration that the trident was never used for any purpose and sections under Arms Act can only be applied if the weapon is used and not on mere possession.

The airport police had registered the case after the Andheri magistrate's court had directed them to lodge an FIR under the Arms Act and IPC, while deciding on a private complaint filed by one Asad Patel. In his complaint, it was alleged that Radhe Maa carried a trident on a flight in August 2015. He had approached the court seeking registration of FIR as carrying of weapons was strictly prohibited on flights by authorities.

The petition prays for quashing and setting aside the FIR registered, stay the execution and operation the impugned order passed by the Andheri magistrate. Direct the authorities to not take coercive action against her. All further proceedings should be stayed. The petition will come up for hearing in due course of time.
