Even as the Supreme Court gears up to adjudicate upon the legal validity  of triple talaq, a Muslim lady, Shagufta, has written to Prime Minister Narendra Modi as well as UP Chief Minister Yogi Adityanath in the third month of her pregnancy, fearing divorce from her husband if she gives birth to another girl. In her letter to the Prime Minister, the lady has sought his intervention to bring an end to the system of triple talaq. Shagufta said she’s been married to Shamshad, a resident of Budhakheda village, for five years. They have two daughters.

Talking to DNA, she claimed that her in-laws have been pressurising her to abort the foetus, as they ‘fear’ she may once again give birth to another girl. She also alleged that her husband has verbally divorced her and thrown her out of the house.

The police said the case was reported to them on March 24 and they have already  filed an FIR and begun  investigations. Shamshad and his brothers Naushad, Zafar Ali and Iliyas have been booked for attempting to prevent a child from being born alive, under section 315 of the Indian Penal Code. Angry over her third pregnancy, her in-laws allegedly want her to abort her three-month-old foetus. She also alleges that she was assaulted by her in-laws and her husband, who gave her ‘triple talaq’ (verbal divorce) and threw her out of the house after she refused to abort. In her letter, she wrote that Shamshad had also hit her on the stomach in an attempt to kill the foetus.

Shagufta told DNA that her daughters are aged four and two-and-a-half years. She said even after filing the police complaint,  she didn’t get justice. She said: “My husband thrashed me and then called his relatives and in their presence uttered ‘talaq, talaq, talaq’  (to me),” she said, adding, “I  fainted and went unconscious.”

The woman told the PM and the CM in her letter that she had voted for them and done her job. “It is now your turn to give me justice. Now we will see what you can do for us,” she said. “I am of the opinion that such people (like her husband) should be punished.. No other woman should go through what I went through. Now only Modiji can bring me justice,” she told DNA.
