The publishers had yesterday moved the application for withdrawing their case against Rameshwari Photocopy for selling photocopies of parts of their books to students.
The plea was accepted by Justice Rajiv Sahai Endlaw today when it came up for hearing.
The publishers -- Oxford University Press, Cambridge University Press (UK), Taylor and Francis Group (UK) and Taylor and Francis Books India Pvt Ltd -- said they decided to withdraw the suit as they did not want to engage in a legal battle with their stakeholders-- the educational institutions.
The publishers had in a joint statement yesterday also said they will not challenge in the Supreme Court the Delhi High Court's December 9, 2016 judgement allowing the shop to continue selling the photocopies of books published by them.
The high court had, however, given them a partial relief by restoring their lawsuit, which was dismissed by a single judge, saying there were triable issues involved in the matter.
The single judge in his order had allowed the shop to sell photocopies of textbooks, saying copyright in literary works does not confer "absolute ownership" to the authors.
Rameshwari photocopy service runs a shop in the precincts of Delhi School of Economics.
