Bhagwat's remarks had stirred up the hornet's nest with the Opposition coming down heavily on him demanding an apology.
A case has been filed against Rashtriya Swayamsevak Sangh (RSS) chief Mohan Bhagwat at a lower court in Bihar's Muzaffarpur district, for allegedly "insulting the Indian Army".
On Sunday, Bhagwat kicked off a controversy when he said, "Sangh can be battle ready in two-three days if the country required it and laws permit it. We are not a military organisation but we have such discipline."
The case has been lodged in the court of the Chief Judicial Magistrate (CJM) Hari Prasad by M Raju Naiyyar, a resident of Mithanpura in Muzaffarpur town. The matter has been listed for hearing in the court of sub-divisional judicial magistrate (East), Muzaffarpur, on February 15, a local lawyer said.
In his complaint, Naiyyar has accused Bhagwat of "insulting the Indian Army and lowering their morale with his statement". The petition stated, "On February 11, while addressing RSS workers at a local school ground in Mithanpura, Bhagwat said that the Sangh can be ready for a war in 2-3 days while it takes 6-7 months for the Army to prepare for it. This is disrespectful for the Army and its soldiers."

Bihar Chief Minister Nitish Kumar was among those who had defended Bhagwat's statement saying that there was nothing wrong if an organisation or individual wanted to protect the nation's borders. In response to this Bihar's Leader of the Opposition Tejashwi Yadav said, "Both Bhagwat and Nitish should seek an apology from the citizens of India."
