A fast-track court of Bongaon in North 24 Parganas district of West Bengal on Saturday sentenced three Lashkar-e-Taiba (LeT) terrorists to death on charges of waging a war against the state. Of them, two are Pakistani nationals.

The three – Mohammed Yunus, Mohammed Abdullah and Muzaffar Ahmed Rathore – have been convicted under Sections 121 (waging, or attempting to wage war, or abetting waging of war, against the government of India) and 121A (conspiracy to commit offences punishable by Section 121).

The four accused were arrested by the Border Security Force in 2007 from Petrapole on Bangladesh border when they were trying to infiltrate into India. Arms and ammunition were seized from them.

They were slapped with Sections 419 (punishment for cheating by personation), 468 (forgery for purpose of cheating), 420 (cheating), 478 (counterfeiting a device or mark used for authenticating documents), 121 (waging war against the state) and 120B (criminal conspiracy).

The Criminal Investigation Department of the West Bengal Police later took over the investigation. The fourth accused, SK Nayeem alias Sameer, who was the alleged link, is a resident of Maharashtra. He had escaped while on transit and is absconding.

The CID officials said that the accused had been trained by the LeT and were experts in making explosives. A large quantity of explosives had been recovered from the accused. They also said that Yunus was a member of the suicide squad of LeT. “They had flown in from Pakistan to Bangladesh and had plans to infiltrate through the border in Bongaon,” a CID official said.

He also said that the accused had plans to unleash terror attacks at defence establishments in Kashmir. Narcotics test and brain mapping was also carried out on them.

Nayeem had been interrogated by the Anti-Terrorism Squad of Mumbai Police regarding his alleged involvement in the Mumbai train blast. In 2013 while he was in transit to Maharashtra for his appearance at a court, he had jumped off a moving train and escaped. He had been absconding since then.

“The case was being handled by the CID. They have been sentenced to death by Bongaon Court today,” said Nishat Parvez, DIG (CID-Operations).

While Yunus and Abdullah are residents of Karachi in Pakistan, Ahmed hails from Anantnag in Kashmir.

The CID filed a first charge-sheet on June 29, 2007. The court declared them guilty on January 19.
