Vice principal sentenced to six months jail for assaulting teacher

The 55-year-old former vice principal of the New Delhi Municipal Corporation (NDMC) school, who was accused of assaulting and outraging the modesty of a 38-year-old female teacher, was sentenced to six months of imprisonment by a Delhi court

Ather Parvez, vice principal of the NP Co-education Secondary School, Kidwai Nagar, was also fined Rs 5,000 along with the sentence by Metropolitan Magistrate Bhavna Kalia.

In addition, the court also directed him to pay a compensation of Rs 25,000 to the victim for outraging her modesty and sexually assaulting her during working hours in the school despite objection raised by her.

“The accused seems to have had the requisite intention to outrage the modesty of the complainant by uttering the words that he said and by acting in the manner he acted towards the complainant. The intention is not a tangible thing and has to be made out from the facts and circumstances of a case,” the judge said.

The court also observed that the accused had “malafide intention” as despite objections from the complainant, the accused did not stop and continued with his behaviour, adding, that he intruded upon her privacy and made her uncomfortable.

According to the complainant, Parvez called the victim to her room on August 13, 2012 after the morning assembly and gave her some personal work which she out rightly refused following an incident of August 9 where the accused had passed inappropriate comments .

Parvez tried to drag the victim’s hand and touched her bosom, while trying to hold her hands. Following this, she slapped her senior and started shouting to alert other staff. She claimed that she was traumatised for a long time after the incident.

The victim also alleged that no action was taken by the NDMC despite a written complaint made by her and other teachers to the Director (Education) of the civic body in-charge of the school.

A case was finally registered under sections 354 (assault or criminal force to woman with intent to outrage her modesty) and 509 (word, gesture or act intended to insult the modesty of a woman) of the IPC after an inquiry was conducted by a Sexual Harrasment Prevention Committee.

However, denying all the charges, the accused said that he was falsely implicated. But the court ruled that the accused had spoken cheaply and harassed her by calling even after the working hours.
