Triple talaq: Wife in Noida makes police complaint against husband

A woman on Wednesday registered a police complaint against her husband in Greater Noida after he gave her 'triple talaq.' The police has registered an FIR under sections 504, 506 and 498A against the accused

In her complaint, the woman, Dilshad Fatma, 32, said that her husband of 13 years, Mohammed Miah, gave her triple talaq after she did not give him a boy. Fatma alleged that Miah, a businessman by profession, divorced her in the presence of her in-laws and a neighbour at his paternal house in Jarcha, in Gautam Budh Nagar, on August 23.

The complainant, who hails from Uttar Pradesh's Dadri district, said they have two daughters. The couple had been living in the Jarcha area for the last 13 years.

"We got married in 2004. In 2006, we had a baby girl who died, after which we had two more daughters. Since we got married, my husband has been demanding Rs 5 lakhs in cash and a car from my parents as dowry which they cannot afford. But still my parents were trying to fulfill his demands," said Fatma.

"On August 23, I was forced to go to my parental home. He also reached there and gave me triple talaq," she added.

"I was asked not to return and threatened by them. The very next day he married a new wife," she said. Fatma added that as soon as she was informed about the Supreme Court's verdict, she decided to file a police complaint in the matter.

"How can this talaq be valid when the SC itself has scrapped it? I will never accept it and I request the police to take strict action against my husband. Where will I go with my two daughters? We demand justice."

Station officer, Jarcha, Shalendra Pratap Singh, said, "The woman visited the police station and filed a complaint. As of now, we have not registered any case as we have to look into the matter legally. Moreover, we also have to verify the complaint and question the woman's husband."

The Supreme Court had, on August 22, banned the practice of triple talaq or instant divorce, whereby a man could divorce his wife by simply uttering the word "talaq"three times.

Analysis

Awareness about the SC verdict should get more Muslim women to fight for their rights to maintenance.

It will, to some extent, curb the practice of forcing the girl's family to give dowry, and then divorcing her if they did not do so.
