Children help woman nab her molester in Tuglakabad

Children playing in a nearby park came to the rescue of a woman as they helped in nabbing a man who was convicted by a Delhi court for outraging the modesty of the victim.

Metropolitan Magistrate Chetna Singh sentenced 45-year-old Sonpal for outraging the modesty of the complainant by doing an obscene act in a public place.

The incident took place on June 5, 2013 when the victim, Rakhi, was waiting for a bus at the Kaya Maya Bus Stand in Tuglakabad to go to her mother's place in Faridabad. While she was over a call with her mother, the accused called her and made a few gestures from his car.

Assuming that it is some known person, she walked towards the car. When she reached near the car, the driver tried to pull her inside the car forcefully and said 'aaja janeman' following which she started shouting for help. Some children playing in the nearby park heard her voice and came at the spot. While one of the children went to the police station near the bus stop to inform the cops, others kept a vigil on the accused.

Sonpal was arrested after interrogation by the police and put to trial after he pleaded not guilty.

The court held that the testimony of the victim is sufficient to prove the case as she is the main witness. Also her testimony was supported by other documents placed on record by the prosecution which include the original statement, rukka, site plan, arrest memo to name a few.

The court also observed that in her testimony, the victim has consistently deposed the sequence of events and also withstood the test of cross-examination.

"The witness has withstood the test of cross examination as well as the rigors of lapses of memory which are naturally possible in such matters in which her testimony was recorded after three long years of the incident. Despite the delay in recording of her testimony, she consistently deposed as regards the sequence of events and withstood the test of examination.

"It has been proved that the accused forcibly pulled the complainant towards himself by pulling her hand and made an obscene gesture and uttered words to outrage her modesty. Thus, the essential ingredients required to bring home the guilt of the accused U/s 354/509 IPC have been fulfilled," the judge said in its order dated July 13.

The judge sentenced Sonpal to a period already undergone in custody considering that his age and on arguments that he was the sole bread earner in his family.
