Chief Secretary assault case: Delhi HC grants bail to AAP MLA Prakash Jarwal with a warning

The Delhi High Court on Friday granted bail to AAP MLA Prakash Jarwal in the case of alleged assault of Chief Secretary (CS) Anshu Prakash. The bail, however, came with a warning to the MLA, of its cancellation in case such illegal activity takes place in future. He was arrested on February 20, a day after he allegedly assaulted the CS at the chief minister's residence.

The bail plea of Okhla MLA Amanatullah Khan who too was arrested in the same case, is, however, pending in the court.

Justice Mukta Gupta while granting bail to Jarwal, observed that the incident reflected on the "trust deficit to the hilt" between the bureaucrats and the legislators in Delhi Assembly. The court also suggested the Delhi government to video graph all future meetings to be held between the two to maintain transparency. Warning the Deoli MLA against intimidating or harassing himself or through someone, and obstructing the work being done by Prakash, it said that the CS and Delhi Police will be entitled to seek cancellation of his bail. The court also directed him to not tamper with evidence or intimidate or approach the witnesses in any manner.

"This FIR being the third FIR against the petitioner (Jarwal) for assault on a public servant, in case the petitioner indulges in any such illegal act in future, the bail granted to him would be liable to be cancelled," it said.

The court also noted that Jarwal was not required for custodial interrogation as the trial court had not granted him police remand.

"In view of the nature of allegations, the sentence provided for the offences invoked if convicted after trial and the fact that there is no likelihood of the petitioner fleeing away from justice, this court deems it fit to grant bail to Jarwal," it said.

The court said there was also no apprehension that he would not be available for trial or flee away from justice. Earlier on, the court had reserved his bail plea, observing that it was a "very unfortunate" situation where both the executive and the legislature were feeling threatened.

  • Prakash Jarwal was arrested on February 20 for allegedly assaulting the chief secretary during a meeting at Chief Minister Arvind Kejriwal’s residence on the midnight of February 19.
