Gujarat HC says to increase salaries of Kendra Sanchalaks

Gujarat High Court's second division bench's order on Monday was a win-win for both Kendra sanchalaks as well as the state government. The Bench directed the government to increase their salaries but rejected the prayer that their services be regularized.

Kendra Sanchalaks, who are Gram Sevaks on government records, were appointed under the aegis of Gujarat Welfare Board. They were on fixed monthly salaries of Rs 900 for Kendra Sanchalak and Rs 1300 for Zilla Sanchalak.

According to the petition, the motive behind constituting the welfare board and hiring them was for the upliftment of farm and rural labourers. The board organises various activities for these labourers for improving their social, economical and educational status. Before the constitution of such board, these activities were conducted by the Mamlatdar. The board was constituted in 1981. Most of these belong to Scheduled Castes or Scheduled Tribes and socially and economically backward class.

The petitioners, 273 in number, had argued that they were not given any break and their services are required from year to year and were working from morning to evening. They claimed that their muster roll was maintained and hence their work can't be called perennial.

Division bench of Justice MR Shah and Justice Biren Vaishnav rejected the petition by Manjuben Patel and others saying the Bench was of opinion that they can't be treated on par with government employees, but directed the state government to raise their salaries. A single Bench had earlier directed the state government to absorb them in permanent jobs.

The Bench however agreed that the salaries were too low at Rs 4500 and Rs 5000 per month respectively for Kendra and Zilla Sanchalaks. These were fixed in 2010 by the single Bench of Justice J B Pardiwala.
