HC upholds appointments of Bengal civic police volunteers

The Calcutta High Court today upheld the appointments of over 1.30 lakh civic police volunteers, setting aside a May 2016 order of its single judge, who had declared these recruitments as valid only till 2016 end.

A division bench of Acting Chief Justice Nishita Mhatre and Justice T Chakraborty set aside the order of Justice Sanjib Banerjee on an appeal by the state government.

Justice Banerjee had in May 2016 annulled the appointments of 320 civic police volunteers in Bankura and had ruled that the remaining 1.30 lakh will have their jobs till the 2016 end only.

Justice Banerjee had revoked the appointments of the civic police volunteers on pleas by nine unsuccessful candidates, challenging the recruitment process.

The nine candidates who had appeared for the interview at Barikul and Sarenga police stations had contended that the civic volunteers were appointed by the state government without any norm and for extraneous reasons.

The petitioners' counsel Bikash Bhattacharya had argued before the single-judge bench that a total of 875 candidates had been interviewed on April 8, 2013 at Barikul police station, while 1,351 candidates were interviewed on April 12, 2013 at Sarenga police station in Bankura district.

He had contended that it was not possible for one set of interviewers to interview so many candidates in one day.

Opposing the claims, state Advocate General Kishore Dutta had submitted before the division bench that all appointments in the state, including those at Barikul and Sarenga, were made in accordance with the law.

The law officer also submitted that the qualities and qualifications of each of the candidates had been duly considered by the panel before selection.

Hearings on the appeal by the state government challenging the single bench order was concluded on March 7.
