Consumer panel notice to city realtor for delay in handing over deluxe flat

The National Consumer Disputes Redressal Commission has issued a notice to Bengaluru-based Millennia Realtors Private Limited on a petition filed by a woman alleging deficiency in service for the two-year delay in handing over possession of a high-end flat worth Rs 3.85 crore.

The bench headed by Justice D K Jain sought a response from the real estate company on the petition filed by advocate Sanjay M Nuli on behalf of Vinita T N.

The complainant contended that she had booked the flat at RMZ Latitude at Hebbal on November 20, 2014, after selling off a property on Cambridge Road. Subsequently, she paid Rs 2.76 crore through cheques as the realtor promised to hand over possession of the flat by September 2015.

“Due to the inordinate delay in handing over the flat, the complainant suffered huge losses and has been living in a rented accommodation for the past three years by paying
Rs 1 lakh per month,” her counsel said.

Reimbursement sought

The complainant also learnt that the builder was involved in a legal dispute with the Bruhat Bengaluru Mahanagara Palike (BBMP).

She has sought reimbursement of the amount along with 24% annual interest, besides compensation for the loss and hardship suffered by her.

The commission posted her petition for consideration on December 5, along with a similar complaint filed by a woman doctor and her mother from Bengaluru against the same company.
