'SC verdict welcome, but reform should have come from within'

The Supreme Court’order which has put a stop on triple talaq until new legislation is passed, has received mixed response in the state.

Former Congress leader Nafees Fazal, who was a minister in S M Krishna ministry, said that the judgment has liberated Muslim women and restored their dignity. “I am very happy that the prime minister took up the cause of Muslim women. Because of triple talaq, women were being abandoned by their husbands, humiliated and oppressed. We are grateful to the three judges who were in favour of abolishing the illegal practice,” Nafees said.

She added that the All India Muslim Personal Law Board should be abolished, saying that there was no sanction for it in the Quran.

Dr Sabiha Bhoomigowda,  professor in Mangalore University, said that though the Quran has a system for divorce which gives ample time for reversing the decision, men were resorting to triple talaq. “Even the Quran says that triple talaq should not be done. But, men have interpreted it as they like and used it to oppress women. The Supreme Court has upheld the basic right of women,” she said.

Sheema Mohsin, a social activist from Bengaluru, said that though the Supreme Court verdict is in favour of Muslim women, it would have been better if the change had come from within the community.

“Even in the Muslim community, the practice of triple talaq is condemned as it is not according to the Shariah. There are a few people who still do it but reformation should have come on its own from within,” she said.

Sheema said that as the Constitution has given them the freedom to practice their religion, there should not have been interference from outside. “It is a very small number of people who do triple talaq. This issue has been blown out of proportion. There are many other women’s issues such as reservation in parliament, education opportunities and female foeticide that the Narendra Modi government could have addressed,” she said.
