Even as the supreme court has been debating on legality of the triple talaq, a 24 year old man in Rajasthan divorced his wife by sending a “triple talaq” letter. After failing to turn up for a counselling session , a harassment and cruelty case has been booked against him.

A cosmetics vendor by profession, Abdul Kalam alias Rizwan of Ghasmandi area of Jodhpur got married to 23 year old Shagufta in 2014. After two and a half years of their marriage, Rizwan divorced her by pronouncing triple talaq through a typed letter in April 2017. The letter arrived as a shock to Shagufta who had come to visit her brother with her 7 month old boy. She told DH, "I received a letter from my husband mentioning triple talaq, which was delivered to my brothers residence in Pratap Nagar locality of Jodhpur. I came here, because my husband had beaten me and asked to leave the house. I waited for one month after receiving the letter but he did not turn up. He says that he can't take his words back."

On Wednesday, a FIR has been lodged against Rizwan after he didn’t turn up for the counseling session that was organised by Shagufta's lawyer at Woman police station as an attempt for reconciliation between the couple.

"After marriage, he and his family members used to ill treat me. He would demand dowry from my parents and on many instances has harassed me. Even after I gave birth to our child there was no respite. Even for the milk and clothes of our new born baby I used to borrow money from my brother." Shagufta added.

As per SHO, Pana Choudhry , Mahilla Thana, Jodhpur, a case has been lodged against him and police will investigate. "Rizwan used to ill treat his wife and hardly paid attention to his son. Rizwan has bluntly refused for any resolution with his wife." An FIR, has been lodged against him under section 498A (Husband or relative of husband of a woman subjecting her to cruelty) 406 IPC (Punishment for criminal breach of trust).

Nishat Hussain, Rajasthan General Secretary of Bharatiya Muslim Mahila Andolan told DH, "Our organisation is opposing this talaq. As far as the Quran is concerned, there is no mention of triple talaq in it. It is a later addition. The right to divorce is given equally to both parties.”
