SC final hearing of BSY land scam case on July 22

The Supreme Court on Monday put for final hearing on July 22 a plea filed against a Karnataka High Court order quashing sanction for prosecution of former chief minister B S Yeddyurappa in land scam cases.

A bench of Justices J Chelameswar and S Abdul Nazeer refused to pass any order for now on a plea for stay of the proceedings in a private complaint filed in the matter before the trial court.

“We will examine the issue,” the bench said, brushing aside a plea by senior advocate K V Vishwanathan, appearing for the state BJP president.

Appearing for complainant Sirajin Basha, senior advocate Gopal Subramanium, however, agreed before the apex court that he would not pursue the matter before the trial court till the matter was heard in the apex court.

Basha's counsel also submitted that the complaint before the trial court would come up to consider its maintainability on February 22. He, however, sought direction for transfer of a pending writ petition before the high court challenging Governor Vajubhai Vala's order of December 4, 2015 declining sanction for prosecution of Yeddyurappa.

The court said it would not pass any order and would finally hear the matter, arising out of a special leave petition filed by Basha against the Karnataka High Court order of November, 2015 which had quashed the sanction by previous Governor Hansraj Bhardwaj for prosecution of the BJP leader.
