High court can't exercise contempt in DRT case: Mallya

Liquor baron Vijay Mallya on Friday moved an interlocutory application (IA) requesting the high court to recall its order to be present in person on November 24 for framing charges under Contempt of Courts Act for violation of his oral undertaking before the Debt Recovery Tribunal (DRT), Bengaluru bench.

In his application, Mallya contended that the high court had no jurisdiction to exercise powers conferred under Contempt of Courts Act as the DRT is not subordinate to the high court. 

Hearing the IA, a division bench of Justices Jayant Patel and Arvind Kumar posted the hearing to December 2. The high court on October 20, 2016, had directed Mallya to be present in person for framing of charges against him. The court held that there was prima facie case to frame charges against Mallya.

Soujanya caseThe high court on Friday stayed the summons issued by a special CBI court against three persons in the sensational Soujanya rape and murder case in Ujire near Dharmasthala. 

The petitioners Dheeraj Jain, Malik Jain and Uday Jain had stated that the suspicion against them was false and baseless. They submitted that some disgruntled persons were concocting stories to help the accused Santhosh Rao. During the hearing on the case, the victim’s father had filed an application seeking to implead the three. 

The CBI court had issued summons to the three to appear before the court on November 29. The case was investigated by the CID before it was handed over to the CBI. The CBI concluded that Santhosh Rao alone had committed the murder. It had also  found that he was mentally sound, but trying to put forth a false claim otherwise.
