Poll plea: HC notices to mayor, deputy

The High Court on Thursday ordered notices to Mayor B N Manjunath Reddy and Deputy Mayor Hemalatha Gopalaiah in a writ appeal, challenging the single bench order allowing legislators and parliamentarians to vote in mayoral elections.

The appellants, Manjunath Raju, corporator from Kadu Malleswara ward and others, had challenged the single bench order. They had questioned the Constitutional validity of Section 7 of the Karnataka Municipal Corporations Act, 1976, which talks about the constitution of the Corporation, enabling MPs and legislators to vote in the mayoral elections.

The petitioners had said Section 7 of the KMC Act violates Article 243 (R) of Indian Constitution by treating MPs, MLAs and MLCs on a par with corporators. Notices were ordered to the state and the BBMP.  A division bench comprising Chief Justice S K Mukherjee and Justice Ravi Malimath ordered the notices and adjourned the hearing.
