Govt seeks time on debt tribunal appointment

Assistant Solicitor General Krishna S Dixit on Thursday sought two weeks’ time from the High Court to ascertain as to when a permanent member could be appointed to the Debt Recovery Appellate Tribunal (DRAT) at Chennai.

Metallurgical Services Company has approached the court urging it to direct the manager of Indian Bank to refund part of pre-deposit or accrued interest on the entire pre-deposit including an amount of Rs 72 lakh deposited. M S Subramaniam, 75, who represents the firm, contended that in 2010 on the direction of the DRAT, a meagre interest amount was released, which was not sufficient for his medical expenses and other financial needs.

The petitioner is aggrieved that there has been no judicial function in the appeal pending before the DRAT as the tribunal is without the chairperson since January 2016. A division bench of Chief Justice S K Mukherjee and Justice Ravi Malimath adjourned the hearing until after two weeks.
