SC to consider state's plea against HC relief to BSY on July 7

The Supreme Court on Thursday posted for consideration on July 7 a petition filed by the Karnataka government challenging the High Court’s order, which quashed as many as 15 FIRs against former chief minister and BJP leader B S Yeddyurappa lodged by the Lokayukta relating to denotification of land.

A bench of Justices A K Sikri and R K Agrawal told senior advocate Vikas Singh, appearing for the state government, that the matter would be considered after the summer vacation.
In its special leave petition, the government sought an immediate stay of the high court’s January 5 order. The Karnataka police through the state contended that there would be “enormous loss” to the state exchequer as the ongoing investigation was on the basis of materials and did not solely rely on the findings of the Comptroller and Auditor General report.

Allowing a batch of 15 petitions, the high court’s single judge had held the CAG report could not be the basis for registration of FIRs relating to the denotification of lands acquired by the BDA in Bilekahalli, Halagavaderahalli, J B Kaval and other places in Bengaluru city when Yeddyurappa was the chief minister.
