JOIN USThe Special Investigation Team (SIT) has written to the Home Department seeking permission to file Special Leave Petition (SLP) before the Supreme Court challenging the bail granted to suspended Joint Commissioner (PRO) Lokayukta Syed Riyaz by the Karnataka High Court.
The High Court had granted bail to Riyaz and three other accused – Ashok Kumar, Srinivasa Gowda and Shankare Gowda in the first case (56/2015) based on the complaint by Bengaluru Urban Zilla Panchayat Executive Engineer P N Krishnamurthy.
The High Court stated that since the SIT sought one week time to file charge sheet in the first case, the bail will be executed from September 16.
Sources said that the 60-day stipulated time for the investigating agency to file the charge sheet when the accused are still in judicial custody would end on September 16 and the bail has been ordered to be granted from that day.
The SIT chief and ADGP (Prisons) Kamal Pant has written the letter (56/SIT/CRM/2015A) to the Home Department on Friday.
The Lokayukta Special Court had dismissed the bail applications of all the accused on August 14. In its objections, the SIT had stated that Syed Riyaz was the main accused in the cases of corruption and extortion within Lokayukta office.
The investigation has revealed that V Bhaskar and Ashok Kumar, other common accused in most of the cases being probed by the SIT, were in constant touch with Riyaz.
“Syed Riyaz is the main accused in the first case and is responsible for destroying the evidence, mobile phone used to call the executive engineer. The SIM card used for the crime was also destroyed on the instructions of Riyaz. We are contemplating to move the Supreme Court challenging the bail order,'' an official said.
