A company secretary, who turned up to depose in defence of the 2G scam accused, accepted before the special CBI court that Shahid Usman Balwa and Vinod Goenka had control over both DB Realty Limited and Dynamix Realty Limited.

The acceptance by defense witness Jignesh Shah came during his cross examination in the court as special CBI judge OP Saini intervened and asked him to tell who were in control of the two companies.

“Who controlled these two entities (DB Realty Limited and Dynamix Realty)? There has to be someone in control. Don’t tell me its board of directors (which was in control). Tell me the names. I am asking for names,” the special CBI judge asked the defense witness.

Responding to the court’s question, Shah told the court that Balwa and Goenka along with other directors on the board were in control of the two companies. He, however, had denied the same just a minute back when senior public prosecutor of the CBI Anand Grover had asked him the same question. “To my knowledge, Shahid Usman Balwa and Vinod Goenka were not in control of DB Realty and Dynamix Realty,” he had told the court.

After Shah deposed in the court that Balwa and Goenka were in control of the two companies, he volunteered to add that an oversight committee was in control of the financial matters of the two companies.

Shah, who had assisted Dynamix Balwas Infrastructure Private Limited in taking over STPL, deposed in the court as a defense witness of Mystical Construction Private Limited in the money laundering case of the 2G spectrum allocation scam.

After the court concluded the examination of Shah, defense lawyer Mudit Jain told the court that he did not wish to bring any more defense witness.
