A class 12 girl was allegedly raped by her neighbour in south Delhi’s Safdarjung Enclave on Tuesday.

An alarm was raised by the girl’s 12-year-old cousin brother who suddenly dropped in at the house. The accused was nabbed and handed over to police.

The victim hails from Uttar Pradesh’s Etah district. Police said she lives with her family in Humayunpur of Safdarjung Enclave.

The accused identified as Surendra was initially booked for sexual harassment.
He was charged with rape only after the victim’s statement was recorded under section 164 of the Code of Criminal Procedure before a Sub-Divisional Magistrate.
The girl claimed that she was alone in the house when the incident took place on Tuesday morning.

When her cousin brother came to the house, he found the door locked from inside.
The girl’s family members claimed that Surendra refused to open the door despite repeated knocks.

When he finally opened the door, Surendra somehow managed to flee.
Her family members then approached the local police station and filed a complaint.
On Tuesday, the victim did not claim that she was raped, but just said she was sexually harassed.

Accordingly, Surendra was arrested.

He was booked under sections 354 (assault or criminal force to woman with intent to outrage her modesty), 342 (wrongful confinement) and 452 (house-trespass) of the Indian Penal Code and section 8 of Protection of Children from Sexual Offences.
On Wednesday, during her statement in the court, the girl said she was raped.

A medical examination of the girl also confirmed sexual assault.

Section 376 of the IPC has been added in the existing FIR. The chargesheet as per new norms will be filed within 20 days.

Not juvenile

Surendra claimed he is a juvenile, but police have denied it. Police said they have recovered documents from Surendra’s house to confirm his age.
