Raze Kanjurmarg dump wall: Bombay High Court

Two months after pulling up the Municipal Corporation of Greater Mumbai (MCGM) for constructing an illegal compound wall around the Kanjurmarg dumping ground, the Bombay high court on Friday gave orders to the BMC to demolish the wall within two months. Hearing a petition filed by MCGM, a bench of chief justice D.H. Waghela asked the petitioner to also submit a report within two months after the demolition of the controversial wall, which falls under the Coastal Regulation Zone (CRZ). The petition was filed by MCGM in 2013, challenging a 2013 order of the central government, which had asked the civic body to demolish the compound wall as the construction is totally banned in the area.

As MCGM council in past had accepted that the wall violated the CRZ regulations; they had argued that Kanjurmarg dumping ground was the only one in the city which had a protective wall. MCGM had tried to justify the presence of the wall saying that it served the purpose to protect area from encroachment and illegal occupation of the land by anti-social elements. “Because of the wall, there are no encroachments and the land is free from anti-social elements,” the civic body had said.

However, since the construction was done in the CRZ jurisdiction, the Bombay high court deemed it illegal and has given instructions to the civic body to demolish the same. The high court said that since MCGM accepts that it is an illegal construction, violation of the CRZ norms couldn’t go unnoticed.
