The Mumbai police on Tuesday filed its reply objecting to the application filed by Zabiuddin Ansari alias Abu Jundal seeking to recall Pakistani-American terrorist David Coleman Headley as a witness in the 26/11 trial because he wanted his defence lawyer to further cross-examine him on certain aspects.

Jundal’s defence lawyer Khan Abdul Wahab last month had filed an application seeking to recall Headley as a witness in the case for further cross-examination.

According to the defence lawyer when Headley was cross-examined on the last day, his client (Jundal) wanted to give certain instructions to him in respect of cross-examination but that could not be done.

The court had allowed the defence lawyer to take instructions from Jundal through video conferencing because he was in Arthur Road jail, but Jundal wanted to meet his lawyer in person and felt giving instructions via video conferencing was not a reliable source.

Jundal’s defence lawyer cross-examined Jundal for four days but later in the absence of instructions the defence did not further cross-examine Headley. Special judge G.A. Sanap had asked the prosecution to file reply on the application filed by the defence.
