Court rejects accused’s plea in attempt on Nusli Wadia case

A special CBI court recently rejected an application by Ivan Sequeira — an accused in the 27-year-old case of attempt on Bombay Dyeing Chairman Nusli Wadia’s life — requesting the court to allow him to depose and give a fresh statement under section 313 CrPC.

Special CBI court judge H.S. Mahajan on September 17 rejected Sequeira’s application, requesting the court to allow him to depose and give a fresh statement under CrPC section 313. Under this section, the court allows an accused to say anything he wants to divulge about the case.

Judge Mahajan in his order noted that Sequeira had made a similar application in 2014 and the court at that time had rejected the application and after that, the trial continued and the applicant’s statement under section 313 was also recorded. According to the judge, at that time, Sequeira was specifically asked if he wanted to say anything more but the applicant denied he wanted to say anything else. The judge said that at that time, he had a copy of the confessional statement with him and hence, his application to allow him to depose to give an additional statement could not be allowed.
