NGT to punish builders who fail to comply with space and environmental regulations

Trying to squeeze in residential towers in a society, against promises made to residents and the environmental clearance granted, could get a builder into trouble. The National Green Tribunal (NGT) on Thursday issued a notice to Raheja Developers and the Haryana Government on a similar issue.

NGT SEEKS REPLY FROM RAHEJA DEVELOPERS

Reportedly, buyers and residents of Project 'Atherva,' which is developed by Raheja Developers in Gurgaon approached NGT after the builder allegedly failed to provide sufficient open space between its towers. As per the undertaking, the builder had to erect towers with a 13 meter gap, said residents. Allegedly, this was not done to save land and money, and build more towers. The residents of 'Atherva,' subsequently, approached NGT and prayed for the demolition of buildings and towers which are not developed as per information provided by Raheja Developers while seeking environmental clearance.

NGT has now asked Raheja Developers, the Ministry of Environment and Forests and the Haryana State to file a reply within two weeks. The next date of hearing in the matter is 6 December. A spokesperson of the Raheja Developers, however, contended that three of the complainants who have filed the present case before NGT are allottees and defaulters in making payment and the fourth complainant is a blackmailer against whom Raheja Developers Limited (RDL) have got registered an FIR in the Saket Police Station, in 2015.

MOTIVE JUST TO EXTORT MONEY?

"The motive of the complainants is just to harass and pressurise RDL to extort money and settle the aforesaid FIR," the spokesperson said. Raheja further said: "The proposed built-up area as per conceptual plans had been more than 1,50,000 Square Meters, RDL applied for Environmental Clearance(EC) under provision of MOEF EI Notification, 2006 as applicable to building, construction and township projects. The EC was granted on 1st April, 2009 and was awarded a Gold Grading.
