Mumbai: Resident doctor files FIR against patient's kin after assault at Sion Hospital

The man assaulted the doctor after he learnt about his father's death followed by which an FIR was filed against the kin.

A resident doctor of Sion Hospital in Mumbai filed an FIR (first information report) against a patient's kin for assaulting him after he failed to save a person's life.

The doctor Ajay Athavle, 26, filed the complaint against Sunil Kale, who allegedly intimidated and threatened him. The incident took place when the doctor informed the patient's family that they could not save his life.

Sunil Kale, 26, elder son of the deceased started shouting at Athavle after learning about his father's death. Initially, he alleged that the hospital doesn't have proper facilities and management to save a patient's life. When Athavle explained to Kale that his father's condition was critical when he was brought to the hospital, he assaulted the doctor physically.

He grabbed Athavle by his shirt and raised his hand at him but, Kale's younger brother intervened and ended the matter then. However, when Athavle was returning towards the doctor's room, Kale threatened him saying, "meet me outside the hospital, I will teach you a lesson".

Kale has been booked under section 4 of the Maharashtra Medical Act and section 353 (Assault or criminal force to deter public servant from discharge of his duty) and 506 (Punishment for criminal intimidation) of the Indian Penal Code (IPC).

This incident has only add fuel to the simmering fire among the medical fraternity over the recurrent attacks on doctors and medical establishments. In March 2017, resident doctors had gone on strike after a series of attacks on the doctors and returned to work after the High Court's intervention and Chief Minister Devendra Fadnavis's assurance of providing enough security.

A senior officer from Sion police station said that the case is not of assault but of heated arguments. However, further enquiry in the matter is underway. The accused has not been arrested now given his father's demise and pending last rites.
