BMC demolishes five floors of building where Mumbai Congress ex-prez stayed

Brihanmumbai Municipal Corporation's H-East ward office demolished five illegal floors of Avadhut Building in Kalina, Santacruz East on Thursday. Kripshankar Singh (Mumbai Congress ex-president) and his son Sanjay Singh were residing in the pent house on the top three floors. The developer did not have a commencement certificate for construction beyond the eighth floor.

While Kripashankar Singh and his son could not be contacted, sources close to the family claimed that they had rented the pent house because their Bandra residence was under renovation. The pent house was in the name of the developer. While Singh's family had shifted a week ago, half of their belongings were still in the apartment.

The action was long pending since the developer and the residents had already approached the court. The Building Proposal Department of BMC had rejected the plan the developer had submitted for the eighth to the twelfth floor, still he went ahead with it.

"The ward had served him a notice two years ago, which he had challenged in the city civil court. When the court disposed the matter off, he appealed in High Court, where also the petition was disposed since he did not have any permission from BMC," said Gaikwad.

Gaikwad said that Thursday's action was following a proper notice issued by the ward office to the developer and the occupants. They were asked to vacate the flats so that the illegal parts can be demolished. "However, this time, residents approached the court to seek an elongation of their stay, claiming they had invested in the flats without knowledge about the illegal construction. The court however disposed the matter, allowing the civic body to step in.

Brian Miranda, Congress Corporator from the ward said that the nobody knew about the illegality until BMC served the notice. Many had also taken loans to avail the flats. "The flat owners, though innocent, have been rendered homeless," said Miranda.
