CHANDIGARH: The Park Plaza Hotel in Sector 17 has moved court demanding officials of various banks and a bad loan restructuring firm, who had sealed the hotel on a court order for failing to pay back a loan amount of Rs 130 crore in August this year, be booked for theft.
The James Hotels Limited, the company that was running the hotel, filed the complaint against eight Punjab National Bank and three United Bank of India officials, vice-president of Asset Reconstruction Company Limited (Arcil), and five members of Bharatiya Janta Yuva Morcha (BJYM), the youth wing of BJP, in the court of chief judicial magistrate Akshdeep Mahajan.

"A mob that included Tarun Bhutani, law officer of PNB, Inder Pal Singh, tehsildar, Gaurav Goyal, assistant advocate general, Haryana, and BJYM state general secretary, and others damaged the property of the hotel by scattering items, ate food and drank beer during the sealing process," the complaint alleged.
The hotel has attached photographs of CCTV footage that purportedly show the manhandling and assault of the hotel staff by the mob. "Even the key decoding machine was taken away and with its help, the mob entered into the rooms of guests," the complaint claimed. "Photographs show that people took away eatables, soft drinks and expensive liquor bottles," the complaint alleged.
The complaint further stated a CCTV footage showed a car containing chocolates that were taken away from the mini-bar of the hotel.
Hotel counsel A S Sukhija said, "There was no such order that said that anything found in the hotel can be taken along by anyone."
Sukhija had moved the complaint on December 6. The court would record the statement of the complainant on the next date of hearing on December 21.
The hotel has requested the court to take action against the bank officials and others under sections 147 (rioting), 342 (wrongful confinement), 382 (theft after preparation made for causing death, hurt or restraint in order to the committing of the theft), 395 (dacoity), 403 (dishonest misappropriation of property), 452 (house-trespass after preparation for hurt, assault or wrongful restraint), 504 (intentional insult with intent to provoke breach of the peace), and 510 (misconduct in public by a drunken person) sections of the IPC.
