HC admits plea seeking CBI probe into DND case
NOIDA: The Delhi high court on Wednesday admitted a plea seeking a CBI inquiry into the alleged fraud in the concessionaire agreement between Noida Authority, Noida Toll Bridge Company Limited (NTBCL) and Infrastructure Leasing and Finance Services (ILFS) for the DND Flyway.
A division bench comprising Chief Justice G Rohini and Justice Sangeeta Dhingra, who admitted the PIL of the Confederation of NCR Residents Welfare Associations (CONRWA), has sought replies from Noida Toll Bridge Company Limited (NTBCL), Noida Authority and ILFS (Infrastructure Leasing and Finance Services).
The next date of hearing is March 8, 2017.
NTBCL, while requesting dismissal of all writ petitions on the matter including those from CONRWA, Centre for Sai Legal and one from Nawab Singh Nagar (which were clubbed together), argued that since the Supreme Court had passed orders for a Comptroller and Auditor General audit into the issue on Nov 11, 2016, following Allahabad high court’s earlier final order on the same, all writ petitions be dismissed.
However, the court chose to ignore the demand and agreed to the CONRWA PIL of Oct 31, 2015 based on the latter’s argument that “the case is of ‘quid pro quo’ and bureaucrats’ connivance with private companies have played fraud thereof,” said Chetan Sharma, secretary general, CONRWA.
The CONRWA PIL of Oct 31, 2015 on DND has pleaded for a high level inquiry by a retired high court judge and CAG to look into the concessionaire agreement of April 7, 1992 between NTBCL, Noida Authority and ILFS, quashing of their MoU of April 7, 1992, takeover of all operations of NTBCL by a senior officer of the CAG, lodging of criminal investigation/prosecution, steps to recover all siphoned funds and to recover all surplus land procured for DND.
