MUMBAI: Bombay high court declined a plea to set up a high power committee headed by a retired judge to examine whether preacher Zakir Naik's speeches constitute an offence.
A bench headed by Justice Abhay Oka on December 2 heard a public interest litigation by Sohail Shaikh which said on the basis of information given by Bangladesh, the National Investigation Agency and other agencies have begun a probe against Naik.
Terming the investigations illegal, Shaikh said the government must appo int a committee and only if it finds something they should proceed against Naik.
The bench agreed with the Centre's advocate Sandesh Patil that PIL is not maintainable at the instance of Shaikh. Dismissing it, the judges said no interference is called for in the inquiry which is going on.
