THE PUNJAB and Haryana High Court on Friday dismissed the bail petition filed by one of the key accused, Dilawar, in the case of arson and loot at Haryana Finance Minister Captain Abhimanyu’s house in Rohtak during the Jat reservation agitation on February 27.
The orders came from Justice AB Chaudhuri after Haryana’s Additional Advocate General Deepak Balyan contended that since the state government has referred FIR in the case for CBI probe, the accused should approach the Haryana’s special CBI court in Panchkula.
CBI’s special public prosecutor Sumeet Goel also submitted that the case has been transferred to the CBI and there was no reason for the court to entertain his bail plea.
Earlier, the HC had also directed the Rohtak trial court to attach Dilawar’s property.
Jasbir Singh, Additional District and Sessions Judge in Rohtak, had on July 12 refused to release Dilawar on bail from Rohtak jail.
FIR in the case was registered on February 27 at Urban Estate police station in Rohtak. A mob, armed with deadly weapons, petrol bombs and torches, had ransacked, looted and set the house of Captain Abhimanyu on fire and also set seven vehicles parked inside the residential complex ablaze.
Balyan had informed the court that while denying bail to Dilawar, even the Rohtak district court had observed that two eyewitnesses in the case, namely Naveen Dhull and Ram Niwas Hooda, in their statements made before the magistrate, had said that Dilawar was present at Captain Abhimanyu’s house during the loot. Even Dilawar’s mobile tower location had confirmed his presence, submitted the state counsel.
